Would black mold voide my lease?

So, would this allow me to get out of the lease?

Also, I was not present at the time of the walkthrough and the water was running down the pipe and dripping behind the wall

I'd call the local health department to get a real answer ASAP. You definately have some legal options, consult with them and perhaps a lawyer. Mold is a big no no in realestate…

Only if the apartment does not offer to move you to another apartment without black mold…………
Go talk to the Property Manager, if that does not work, contact the apartment complex owner….

From what you said, the mold could be impacting you and your wife. You both need to move out as soon as possible. For your health you and your wife need to leave.
Legally you have the right to leave an apartment/house that is filled with mold. No one expects you to live there with the mold. Take pictures of the mold, document the consersations you've had with the landlord about the mold. Send the landlord a certified letter indicating you and your wife are moving out immediately because the mold is causing health problems.
You may want to file against the landlords health insurance since the mold is making you sick. Since the mold is impacting your heath and your wife's health you need to seek out an attorney. This could cause long term effects. You need legal help. An attorney should be willing to take on your case for a percentage of the settlement.

I would say an apt with black mold is uninhabitable. Didn't you do a walk thru before moving in and noticed the sink was leaking?

Black mold does not instantly void your lease. You need a judge to do that. Pay $35 in Small Claims Court..

hi, sounds like yu have been exposed to toxic mold, get proof by calling a pro mold tester for toxic mold. then your lease is void and your landlord is responsible for all moving health expenses
